1. About these terms and who we are
This website (nutrichem.com) and our online store (shop.nutrichem.com) (together, the “Site”) are operated by Nutri-Chem Pharmacy Limited (“NutriChem,” “we,” “us”). By accessing or using the Site, you agree to these Terms of Use and to our Privacy Policy below. If you do not agree, please do not use the Site. Our clinic and pharmacy services are delivered in Ontario and are governed by the health-privacy terms in Section 8 below, not by the website privacy policy in Section 7.
No medical advice; no practitioner–patient relationship
Content on the Site is provided for general information only and is not medical advice, diagnosis, or treatment, and does not replace advice from your physician, naturopathic doctor, pharmacist, or other qualified health professional. Using the Site, reading our content, or purchasing a product does not create a practitioner–patient relationship. If you have or suspect a health problem, contact a qualified health professional promptly, and call emergency services in an emergency.
Natural health products and supplements
The products we sell include our own NutriChem-branded natural health products and products from other brands we carry. Natural health products sold in Canada are regulated by Health Canada and, where applicable, carry a Natural Product Number (NPN) or other Health Canada authorization; some items we sell may be foods or other product categories regulated differently. Statements about these products have not been evaluated as drugs, and the products are not intended to diagnose, treat, cure, or prevent any disease. Individual results vary. Read all product labels and directions, and consult a health professional before use, particularly if you are pregnant or nursing, taking medication, or managing a health condition.
For products manufactured by other brands, NutriChem is a retailer, not the manufacturer. The manufacturer or brand owner is responsible for its product, including its formulation, labelling, claims, and regulatory compliance. Product descriptions, images, and claims for third-party products may be supplied by the manufacturer, and any product warranties are provided by the manufacturer, not by NutriChem, except as required by law.
The online store: orders, pricing, and payment
All prices are in Canadian dollars unless stated otherwise. We make every effort to describe and price products accurately, but errors can occur; we may correct errors, and cancel or decline any order (including before shipping), and we will notify and refund affected customers. Product availability is not guaranteed, and we may limit quantities. Your order is an offer to purchase, and our acceptance occurs when we ship. Payment is processed through a secure third-party payment processor.

Shipping and international orders
We ship within Canada and to other countries we designate. Delivery timelines are estimates. Title and risk of loss pass on delivery to the carrier. For orders shipped outside Canada:
• You are the importer of record and are responsible for any duties, taxes, customs charges, and compliance with the destination country’s laws.
• Natural health products lawful for sale in Canada may not be approved or permitted in your destination country. It is your responsibility to confirm you may lawfully import a product, and we are not liable for products detained, seized, or refused by customs.
• We ship only natural health products and general merchandise internationally. We do not ship prescription drugs or compounded prescription medications outside our licensed scope.
Prescriptions and pharmacy services
Our pharmacy and compounding services, prescription consultations, minor-ailments assessments, deprescribing, and bioidentical hormone preparations are provided through our licensed Ontario pharmacy and are regulated by the Ontario College of Pharmacists. These services are not available through the general online store, are provided only where we are lawfully permitted, and are subject to applicable prescription and controlled-substance requirements. Nothing on the Site is an offer to dispense a prescription drug outside our licensed scope.
Privacy Policy (website and online store)
This Section explains how we handle personal information collected through the Site for commercial purposes, under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). Health information collected when you receive care from our clinic or pharmacy is governed by Section 8 below.
What we collect. Information you provide (name, contact details, account and order information, payment information processed by our processor, newsletter sign-up, messages to us) and information collected automatically (cookies, analytics, IP address, device and browsing data).
Why we collect it. To process and ship orders, operate accounts, provide customer service, improve and secure the Site, send you marketing where you have consented, and meet legal obligations.
Consent and marketing. We send marketing emails only with your consent, and every message includes an unsubscribe option, consistent with Canada’s anti-spam legislation. You may withdraw consent at any time.
Service providers and sharing. We do not sell your personal information. We share it only with service providers who help us operate (payment processing, shipping, email, hosting, analytics, booking platforms), bound to protect it, and where required or permitted by law.
Cross-border processing. Some of our service providers may store or process information outside Ontario or Canada, where it may be subject to foreign law.
Cookies. We use cookies and similar technologies for functionality, analytics, and personalization. You can manage cookies through your browser and our cookie banner.
Security and retention. We use reasonable safeguards and retain personal information only as long as needed for the purposes above or as required by law.
Your rights. You may access or correct your personal information, and ask questions or complain, by contacting our Privacy Officer at kpollonmacleod@nutrichem.com. You may also contact the Office of the Privacy Commissioner of Canada.
Children. The Site is intended for adults; we do not knowingly collect personal information from children without a parent or guardian’s consent.
Health Information Privacy (PHIPA)
This Section explains how your personal health information is handled when you receive care from our clinic practitioners or our pharmacy. It is separate from the website privacy policy in Section 7 because health information is governed by Ontario’s Personal Health Information Protection Act, 2004 (PHIPA), and because our clinic care and our pharmacy involve different health information custodians.
Clinic Privacy Statement (naturopathic and clinical care)
Who holds your records. Your treating practitioner (naturopathic doctor, nurse practitioner, or other regulated health professional providing your care) is the health information custodian responsible for the records they create about you. NutriChem Biomedical Clinic Inc. provides scheduling, billing, records storage, and administrative support to your practitioner as their agent, and is not itself the custodian of your clinical records.
What we collect and why. We collect personal health information, your history, assessments, test results, treatment plans, and related records, to assess, diagnose, and treat you, to coordinate and provide continuity of your care, and to meet legal, regulatory, and professional obligations.
How it is shared. Your practitioners and the staff involved in your care, and, where relevant to your care, Nutri-Chem Pharmacy Ltd, may collect, use, and share your personal health information among themselves as reasonably necessary to provide and coordinate your care (your “circle of care”), unless you direct otherwise. We will obtain your express consent before disclosing your personal health information to anyone outside your circle of care who is not a custodian (for example, an insurer, employer, or lawyer), or before using it for marketing. We may also use or disclose it where required or permitted by law, including to reduce a significant risk of serious harm.
Your choices and rights. You may withhold or withdraw your consent to the collection, use, or sharing of your personal health information, in whole or in part, by notifying us in writing, subject to limits the law places on that right. You may also access and request correction of your records.
Contact and complaints. Our Clinic Privacy Officer, Kate Pollon-MacLeod at Kpollonmacleod@nutrichem.com (613-820-4200), is the designated contact person for your practitioners and can help with questions, access requests, and complaints. You may also complain to the Information and Privacy Commissioner of Ontario.
Safeguards and retention. We use reasonable administrative, technical, and physical safeguards, and records are retained and securely destroyed in accordance with PHIPA and College record-keeping requirements. If a practitioner leaves NutriChem, they remain responsible as custodian for the records they created, and we will cooperate in the orderly transfer of your records.
Pharmacy Privacy Statement (Nutri-Chem Pharmacy Ltd)
Who holds your records. Nutri-Chem Pharmacy Ltd is the health information custodian for the records it creates in providing pharmacy services, and its pharmacists and staff handle your information on the pharmacy’s behalf.
What we collect and why. We collect personal health information, prescriptions, medication and health history, allergies, and related records, to dispense and compound medications, provide medication reviews and prescription consultations, assess and treat minor ailments, support deprescribing, and prepare personalized preparations such as bioidentical hormones, and to meet legal, regulatory, and professional obligations.
How it is shared. We may share your personal health information within your circle of care, including with your prescribers and, where relevant to your care, NutriChem’s clinic practitioners, as reasonably necessary to provide and coordinate your care, unless you direct otherwise. We will obtain your express consent before disclosing it to a non-custodian (such as an insurer) for a purpose other than your care, or before using it for marketing, and we may use or disclose it where required or permitted by law. Your choices and rights. You may withhold or withdraw consent in whole or in part in writing, subject to legal limits, and you may access and request correction of your records.
Contact and complaints. Our Pharmacy Privacy Officer, Kate Pollon-MacLeod at Kpollonmacleod@nutrichem.com (613-820-4200), is the designated contact person. You may also complain to the Information and Privacy Commissioner of Ontario, and you may contact the Ontario College of Pharmacists.
Safeguards and retention. We use reasonable safeguards and retain and securely destroy pharmacy records in accordance with PHIPA and Ontario College of Pharmacists requirements.
Accounts and acceptable use
You are responsible for your account credentials and for activity under your account. You agree not to misuse the Site, interfere with its operation, or use it for unlawful purposes.
Reviews and content you submit
If you submit reviews, testimonials, or other content, you grant NutriChem a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it in connection with our business, and you confirm the content is yours to share and is accurate. We may decline or remove content at our discretion.
Intellectual property
The Site, its content, design, and the NutriChem name and logo are owned by NutriChem or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, or distribute Site content except as reasonably necessary to use the Site or place an order.
Third-party links
The Site may link to third-party websites and booking platforms we do not control. We are not responsible for their content or privacy practices; review their terms directly.
Disclaimers and limitation of liability
The Site and its content are provided “as is” and “as available,” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, NutriChem is not liable for indirect, incidental, or consequential damages arising from your use of the Site or products purchased through it. Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for personal injury or death caused by negligence, fraud, or rights you have under the Consumer Protection Act, 2002 (Ontario) or other consumer-protection law; and nothing here limits the professional or legal responsibilities of our regulated health professionals, which are addressed in our clinic and pharmacy materials.
Indemnity
You agree to indemnify NutriChem against claims arising from your breach of these terms or misuse of the Site, to the extent permitted by law.
Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, and you agree to the jurisdiction of the Ontario courts. If you access the Site from another jurisdiction, you are responsible for compliance with local law, and mandatory consumer-protection rights available to you in your home jurisdiction are not affected.
Accessibility
